How to obtain a civil protection order in Ohio

On Behalf of | Aug 15, 2024 | Divorce |

Getting a civil protection order can provide you with the legal backing to ensure your safety. This court order comes designed to prevent contact between you and another person.

Filing the petition

To start the process, you need to file a petition at the domestic relations or common pleas court in your county. The forms are available at the courthouse or online through the court’s website, and you’ll need to provide information about yourself, the other party, and the reasons you believe you need protection. Be as detailed as possible, describing any incidents and why you feel at risk.

Temporary protection order

Once you file your petition, you can request a temporary protection order (TPO). This order offers immediate protection until a full hearing can take place, and a judge will review your request and may ask you questions about your situation. If granted, the protection order will stay effective until your court hearing.

The court hearing

The court will schedule a hearing within seven to ten days after filing your petition. During the hearing, both you and the other party will have the chance to present your sides. You’ll need to provide evidence and any documentation of domestic issues that support your request for a permanent civil protection order.

After the hearing

If the judge grants your request, the civil protection order will outline specific conditions the other party must follow. This may include no contact with you and staying away from certain locations. The order can last up to five years, and you should keep a copy with you at all times.

Moving forward with peace of mind

Understanding the process and taking the right steps can help you feel more secure. Remember, the protection order is a tool to help maintain your safety, and it’s important to follow all the procedures carefully.
